Guten Abend, Herrn und Damen. I have a question about false accusation that might affect custody.
People tend to instinctively regard women as the victims of violance from men, when it comes to conflicts in relationships and marriages, which really worries me.
I dare not start the divorce process without being sure I can prove myself innocent of spontanous violance and I might get the custody of my baby.
Is it possible to prove myself innocent of spontanous violance(every time she hit me first and teo years ago I started to hit back) in the court somehow?
My wife denies hitting me and falsly describes me as a wife beater to other people.
Her father knows her issues and witnessed several situations when I got beaten by her, but in an conflict between me and his daughter, he chooses to lie with his daughter to the policemen.
Currently situation:
We have a baby of 2 months old.
I had two affairs (rarely slept with my wife coz there has been arguments from the start)
I have been married since nearly 5 years. In this marriage there used to be a lot of violance and mental abuse from my wife. But my wife keeps twisting stories and describe me as a violant anf aggressive wife beater.
At the beginning my wife used to hit me, and about 2 years ago, I started to hit her back every time she landed a punch on my face.
A typical situation:
Since the beginning of the relationship, I was not allowed to do literally anything without her permission. Whenever my parents texted me, I had to translate to her what they said and she would decide what I should write back. I was not allowed to touch anything in the flat. I also was not allowed to say certain things. Literally like a prisoner. Her father was also not allowed to bring anyone into his own flat for 10 years when she lived there.
We used to live with her father. Before I began attending German class, she told me I musn't let her father know so(coz she hates his gf). During a conversation with her father, I accidentally said so and, immediately, she slapped me and kicked me in the arse. Her father was of course there.
Another situation:
During a quarral she punched me several times in the eye, her father being absent, and I called her father to take me to hospital. Later came her father with his girlfriend. I rcovered from the pain a few mins later and she let her father beg the gf not to call police.
Once during a quarrel, she punched me in the eye all of a sadden, breaking my glasses. 1 minute later I kicked her in the thigh 3 times.
She then made pics of her thigh and told everyone I hit her, without saying that she hit me first. Since then I hadn't started to keep evidence, it became hard to prove her the spontanous offender.
She also kept the flat in a mess for 4 years and didn't allow me to look for my own clothes in the mess...
Will such issues affect her possibility of custody as well?
